Plaintiff brought this suit to recover $4,145.16 as the value of 36 bales .of cotton alleged to have been sold to defendant through its agent Robert T. Durio. The defense urged to the suit is lack of authority on the part of Durio to purchase the cotton for defendant’s account.. The court below rendered judgment in,favor of plaintiff for $8,850, with interest, and defendant appealed.
