Plaintiffs Jack Friedman, Sidney Greenwald, and the estate of Sandor Kolitch are the licensed operators of the Franklin Nursing Home (“Franklin”), a 320 bed residential health care facility (“RHCF”) located in Flushing, New York. Defendant Cesar Perales is the Commissioner of the State of New York Department of Social Services (“DSS”). Defendant David Axelrod is the Commissioner of the State of New York Department of Health (“DOH”).
