In the suit to settle the estate of John P. Morton, deceased, the following questions have arisen, and are presented by this appeal for decision:

The testator, John P. Morton, died childless. His widow renounced the provisions of the will. Litigations' involving first the probate of the will, and then its construction, ensued; each, of course, creating certain necessary legal expenses.
