This matter is before the Court for consideration of Plaintiff's Motion for Partial Summary Judgment and Defendant's Motion for Summary Judgment. In this Fair Labor Standards Act ("FLSA") case, Plaintiff has moved for summary judgment declaring Defendant cannot, as a matter of law, assert the affirmative defense that Plaintiff was exempt from FLSA provisions under the administrative employee exemption.
