Appeal from a judgment of the County Court of Chemung County (Buckley, J.), rendered October 12, 1999, convicting defendant upon his plea of guilty of the crime of grand larceny in the fourth degree.

In October 1998, defendant was charged by indictment with criminal possession of a forged instrument in the second degree and grand larceny in the fourth degree after he fraudulently obtained $1,700 from a bank.
