The leading facts of this case are as follows. In September, 1841, James Gray appeared at the land-office at Q,uincy, and proved to the satisfaction of the register and receiver, that he was entitled to a preemption to the south-west quarter of section eleven, township seven, north of range eight west, under the provisions of the act'of Congress of. the 1st of June, 1840; and paid the purchase-money, and obtained the receiver’s receipt for the same.
