This was an action of disseisin by Mosier against Smith for a certain quarter- section of land in the Crawfordsville district. Plea, the general issue. Trial by the Court by consent of parties, and. judgment for the plaintiff.
It appears by bills of exception, that Mosier was settled upon, and cultivated a part of the premises described in the declaration, in 1829, and that he was in possession of' the same on the 29th of May, 1830 ; on the 13th of October, 1830, Smith procured from the proper land office the receiver’s *52receipt for final payment for the same tract of land; on the 30th of…
