Appeal from a judgment of the County Court of Rensselaer County (McGrath, J), rendered May 9, 2006, upon a verdict convicting defendant of the crime of manslaughter in the second degree.

During the early morning hours of September 10, 2005, the victim arrived in an intoxicated state at a party held in an apartment in the City of Troy, Rensselaer County, with the expressed purpose of retrieving a shotgun that allegedly belonged to him. *1270Defendant, a close friend of the victim, and another individual, identified as Johnny Falu, both attended the same party and were in possession of shotguns.…
