Appeal from a judgment of the County Court of Albany County (Ryan, J.), rendered July 18, 2001, upon a verdict convicting defendant of the crime of assault in the second degree.

During the early morning hours of October 6, 2000, defendant 1 and two of his friends — Julio Vazquez and Wayne Holmes— were patrons at a bar in the City of Albany. While there, defendant paid a dancer $20 for a lap dance.
