FINDINGS OF FACT

1. On November 26, 1986, Elmer G. Black, a letter sorting machine (LSM) distribution clerk at the Mobile, Alabama Post Office was terminated on charges that he was physically unable to perform the duties of his position.

2. Black appealed his discharge to the Merit Systems Protection Board (hereinafter MSPB) whose Administrative Judge issued an April 16, 1987 initial decision which affirmed the action of the Postal Service (Attachment A of the Hopkins' Declaration).
