When this case was before this court, upon original submission, the court rendered judgment reversing the judgment of the lower court and remanding said cause. Such judgment was in favor of appellant, but nevertheless, appellant petitioned the Supreme Court for a writ of certiorari to review and revise the opinion here rendered.
