CODY, Justice.

This is a suit by a father to recover damages from the City of Houston for the loss of both legs below the knees of his little daughter, caused by a mowing machine which was then being operated by a city employee working for the Street and Bridge Department. The accident occurred on September 4, 1940, at which time the child was three years old. The mowing machine was drawn by a span of mules, and at the time of' the accident was being used to cut weeds in the ditches along Ralston Street, which is a shell-topped highway in a sparsely inhabited neighborhood in Houston, and…
