Appellant is the owner of the land on both sides of White River for a certain distance southward from a point where the line of the Chicago, Rock Island & Pacific Railway Company crosses the river near Devalls Bluff, and he has for many years operated a public ferry across the river, connecting an improved' public highway which runs from the bank of the river on each side a short distance south of the railroad crossing.
