This action was instituted hy J. M. MoClintock against the White River Bridge Company and Harry E. Bovay. For his first cause of action the plaintiff, in substance, alleged that the defendants were liable to him in damages which accrued by reason of the opening of a public road on his land two hundred feet wide, without notice to him, and the déstruction of his ferry business and equipment by the building and operation of a toll bridge on his land.
