In this stockholder’s action brought on behalf of Indian Refining Company (hereinafter “Indian”), cross-appeals| *294have been taken from an order entered on a motion of certain defendants for summary judgment dismissing the. third cause of action on the ground that it is barred by the Statute of Limitations.
