OPINION

BROOKSHIRE, Justice.

Mrs. Jessie Gunter, Appellant, appeals from an adverse judgment rendered after a trial on the merits wherein both the facts and the law were submitted to the District Judge without a jury. No formal findings of fact were requested under the appropriate rules of civil procedure. No findings of fact nor conclusions of law were made or filed in writing.
