MEMORANDUM REGARDING DEFENDANTS’ MOTIONS TO DISMISS AND MOTIONS TO STRIKE JURY DEMAND AND MONSANTO’S MOTION TO TRANSFER

I. INTRODUCTION
In separate actions before this court, two sets of plaintiff-retirees allege violations of the Employee Retirement Income Security Act, 29 U.S.C. §§ 1001 et seq. (ERISA). All the plaintiffs assert that their former employers breached ERISA fiduciary duties, intending to deprive them of pension benefits by making unlawful misrepresentations and engaging in unlawful discrimination.
