The defendant, Salvator Messina, is charged by information with one count each of criminal trespass in the third degree (Penal Law § 140.10 [e]), trespass (Penal Law § 140.05), criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03), and resisting arrest (Penal Law § 205.30). On January 24, 2011, the defendant moved to dismiss the criminal trespass in the third degree and trespass counts on the ground that the information is facially insufficient as to those counts.
