— In an action, inter alia, to recover damages for breach of an agreement to pay the deficiency between the proceeds of a foreclosure sale and a mortgage debt, plaintiff appeals from (1) an order of the Supreme Court, Suffolk County, dated March 5, 1980, which denied its motion for summary judgment, and granted defendant’s cross motion for summary judgment, and (2) a judgment of the same court, entered thereon on April 16, 1980. Appeal from the order dismissed (see Matter of Aho, 39 NY2d 241, 248), without costs or disbursements. Judgment modified by deleting therefrom and from the order…
