Burch, J.:

The action was one by a school teacher against a board of education for breach of contract of employment to teach school. A demurrer to the petition was sustained, and plaintiff appeals.

In May, 1931, the board of education of the city of Clay Center employed Betty Chaffin, a single woman, to teach in the city schools *512for nine months, beginning with the opening of school in September, 1931. The contract of employment was in writing and contained the following stipulation:
