Gleason v. Mann

The plaintiff in this action of contract, to recover for work and labor performed by her for the defendant, has recovered a general verdict upon a declaration containing a count in quantum meruit and a count upon an account annexed. The defendant excepted to the denial of a motion for a directed verdict and to the refusal of his fourth request which called for an instruction that “If express agreement is void as against public policy, there cannot be any recovery on the quantum meruit or other common counts.”
