LOCKWOOD, Justice.

Appellant was found guilty of the crime of petty theft, and appeals from that judgment and the denial of his motions in arrest of judgment and for a new trial.

The facts appear to be as follows: On Friday, February 21, 1961, defendant Paramo was employed on a construction job in Tucson, Arizona, where several sorority and fraternity houses were being built.
