FISHER, Chief Justice.

This is a suit brought by the appellee King against the appellant Sloan to establish the boundary line between them of the lands respectfully owned by each of the parties. Verdict and judgment below were rendered in favor of the plaintiff, establishing the line in controversy in accord with his theory as set out and described in his petition.

Plaintiff in his petition alleges that prior to the year 1862, William Thaxton was the owner in fee simple of a tract of land situated on the south bank of the San Saba River, known as survey -No. 64, patented to the heirs of F.…
