Plaintiff appeals from the jury verdict and judgment entered in the District Court of the Eleventh Judicial District, Flathead County. The jury found the defendants “[not] guilty of negligence which was the proximate cause of Plaintiff’s claimed damages”, and also returned a similar verdict in favor of the plaintiff upon defendant Hoyt’s counterclaim. The District Cotut entered judgment for the defendants. Hoyt does not cross-appeal.

Plaintiff presents two issues for review:
