Faville, C. J. —

I. About 1884, a telephone line was constructed from Storm Lake to Sioux City, passing through the city of Cherokee, and occupying the streets and alleys of said city for said purpose. A toll station was established in Cherokee, and the line was used solely as a toll line, for the transmission, of long-distance messages. Appellant was organized under the name of the Iowa Telephone Company, about 1896, and in September of that year acquired the telephone line between Storm Lake and Sioux City, and has used the same ever since as a toll or long-distance line.
