Three cases from the Osage County District Court have been consolidated for purposes of this interlocutory appeal by the defendant, Missouri Valley Steel, Inc.
On June 17,1978, the Whippoorwill Showboat capsized during a storm at Pomona Lake in Osage County. Several people were killed or injured in the tragic occurrence. These lawsuits have been filed by the personal representatives and survivors of three persons who were killed.
