OPINION ON CROSS-MOTIONS FOR PARTIAL SUMMARY JUDGMENT

This proceeding is before the Court on the plaintiff-trustee’s motion for partial summary judgment and the defendants’ response and counter-motion for partial summary judgment. The plaintiff-trustee was originally represented by counsel Christopher J. Redmond and Brian M. Devling; after the motions were filed, Mr. Devling withdrew and Jacob W.
