I. INTRODUCTION

Plaintiff Charles Langone, as Fund Manager of the New England Teamsters and Trucking Industry Pension Fund (“Fund”), alleges that defendant USCO Distribution Services, Inc. (“USCO”) failed to make pension fund contributions for its temporary employees as required by collective bargaining agreements, in violation of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1145 (2000). 1 USCO disagrees that the collective bargaining agreements (“CBAs”) require it to make contributions to the Fund on behalf of temporary…
