Appeal from an order of the Supreme Court (Meddaugh, J.), entered September 27, 2001 in Sullivan County, which, inter alia, granted plaintiff’s motion for partial summary judgment.
Defendant and plaintiff were married in 1995 and two children were born of the marriage, both of whom are currently under the age of 21. On May 25, 2001, plaintiff commenced an action for divorce. Plaintiff’s attorney drafted a proposed settlement/separation agreement to dispose of matters related to the parties’ divorce.
