Appeal from St. Louis City Circuit Court. — How. Jesse A. McDonald, Judge. (1) There was substantial evidence tending to show that the defendant murdered the deceased. On the other hand, there is evidence that would have amply warranted the jury in acquitting the defendant on the ground of self-defense. If defendant’s account of the tragedy, and that of his witnesses, should be given full credit, then the killing was justifiable.

— This is an appeal from a sentence by the circuit court of the city of St. Louis. The de*130fendant was indicted on the third day of November, 1903, for the mnrder of Luther Lewis in said city on the evening of August 3, 1903. The deceased and defendant were negro men and the scene of the homicide was a section locally known as “Bad Land Alley” between Lucas and Morgan streets and Thirteenth and Fourteenth streets in St. Louis.

On the night of the homicide and for some eight months prior thereto, the defendant made his home at the residence of Dora Booker, also a negress, at 1323 1-2 Linden…
