McFADDEN, Justice.

This appeal arises from a judgment based on a jury verdict finding the appellant, John Salazar, guilty of being a persistent violator of the law. On February 18, 1970, the appellant shot and wounded James Michael Atkins in an altercation occuring in Garden City, Idaho.
