Appellant was tried on an indictment charging murder in the second degree of D.C. Rusk. A jury found her guilty of manslaughter in the first degree and fixed her punishment at five years imprisonment. She was sentenced accordingly.

The deceased was killed by one bullet, from a .38-caliber Smith and Wesson handgun, that penetrated his left chest and was lodged in the front of his spine. Defendant was the only eyewitness to the killing, which occurred about midnight…
