Counsel for defendant, in his brief and argument to reverse said judgment, contends:(1) “The merchandise in question was sold and delivered by the plaintiff to the Union Automobile Company, and there being no evidence to connect the defendant with the Union Automobile Company, there can be no recovery against her.(2) “Even though Mrs. Roberts, the defendant, might have been originally responsible for the price of the goods, the bringing and prosecuting to judgment of the suit against Fred F. Roberts was a bar to a suit against her. ’ ’
