Under date of October 10, 1925, the plaintiff, Dan Longo, addressed a written proposal to McGrath & Swanson Construction Company at Chicago, Illinois, in which he,offered to do the necessary filling upon a tract of approximately two hundred acres of land, located in the southern portion of the City of Chicago and bounded on the east by the Illinois-Indiana state line, to bring the surface of the land up to six inches below the established grade.
