The plaintiff brought an action to recover certain equipment which had been leased to the defendant. The plaintiff also sought to recover the rental value of the equipment for the period of time that the defendant had held the equipment after the expiration of the lease. The defendant counterclaimed, alleging fraudulent misrepresentation of the terms of the lease; he contended that the lease was in fact a lease purchase agreement.
