On January 21, 1949, Blanche Max, plaintiff, was a passenger on a bus operated by the department of street railways and owned by the city of Detroit, defendant. The bus was proceeding west on East Warren avenue, a 1-way street in Detroit. As it approached the intersection of McDougal avenue plaintiff rang the bell indicating her desire to alight at the next stop, located on the northwest corner of the intersection.
