This case came on for hearing upon defendant’s motion to suppress on May 3, 1983. Upon the evidence adduced at the hearing, and the memoranda submitted by counsel, the court makes the following findings and conclusions:

At about 11:35 p.m. on February 21, 1983, Patrolman Larry Gollon, of the Jefferson Police Department, observed the defendant, Larry Jenkins, operating a motor vehicle in the village of Jefferson.
