Nature of the Case and Procedure to be Followed:

This is a criminal case, and as such, it began with the filing of an indictment. Said indictment, in substance, charges the defendant with a violation of R. C. 2903.03, in that on or about the 29th day of May, 1978, while under extreme emotional stress brought on by serious provocation reasonably sufficient to incite the defendant into using deadly force, defendant knowingly caused the death of Steven A.
