I. Introduction
Continental Casualty Company (“Continental”) maintains this declaratory judg ment action in diversity against its insured, Synalloy Corporation (“Synalloy”), and Synalloy’s various primary and excess insurers, for the purpose of having this Court decide which, if any, of these insurers, including Continental, are obligated under the terms, conditions, exclusions, and limitations of their individual policies with Synalloy, to defend Synalloy against certain tort claims asserted by its employees, and to indemnify Synalloy in the event that a…
