ORDER

EDENFIELD, Chief Judge.

After a careful de novo review of the record in this case, the Court REJECTS the Report and Recommendation of the Magistrate on Defendant Gilberg’s motion for summary judgment, to which objections have been filed. The Court agrees with the Magistrate’s conclusion, but arrives there via slightly different reasoning. The Court disposes of Defendant’s motion as if it had been originally lodged with this Court. The motion for summary judgment is DENIED in part and GRANTED in part.
