THE COURT.

Defendant appeals from a judgment imposing the death sentence and from an order denying his motion for a new trial. He was charged with the murder of Marion Berger and three prior convictions of felony. He pleaded not guilty and not guilty by reason of insanity and admitted the prior convictions. The jury found that he was guilty, made no recommendation as to penalty, and found that he was sane at the time the offense was committed. The defendant endeavored to present a motion for a new trial and the minutes of the court recite that such a motion was made, argued, and denied.…
