Defendant and one Brand were charged with two counts of burglary (§ 459, Pen. Code) and grand theft (§ 487, subd. 3, Pen. Code); defendant was charged with unlawful use of force and violence on a peace officer (§ 242, Pen. Code); and Brand was charged with receiving stolen property (§ 496, Pen. Code). Brand pleaded guilty to the last count and the disposition of the others against him was continued. The court sitting without a jury found defendant guilty on all four counts and the burglaries to be in the second degree. Motion for a new trial on count IY (use of force against a police officer)…
