Appeal from an order of the Supreme Court (Dowd, J.), entered October 4, 2011 in Chenango County, which granted defendants’ motion for summary judgment dismissing the complaint.
Plaintiff commenced this action seeking to recover damages for injuries to his right shoulder, including a torn rotator cuff, that he claims were incurred as a result of a March 2008 motor vehicle accident in which he was a passenger in a vehicle owned by defendant Jennifer Woodruff and operated by defendant Coy Woodruff.
