Appeal from an order of the Supreme Court (Ferradino, J.), entered November 6, 2012 in Saratoga County, which granted defendant’s motion for summary judgment dismissing the complaint.

Plaintiff Arthur R. Vandetta and his wife, derivatively, commenced this action to recover damages for injuries that Vandetta allegedly sustained in a motor vehicle accident with defendant in September 2007.
