OPINION

BUSSEY, Judge:

The petitioner, William Greely Allen, was charged in the District Court of Tulsa County with the offense of Assault and Battery With a Dangerous Weapon with Intent to do Bodily Harm. On June 2, 1986, petitioner entered a plea of guilty, but the trial court withheld a finding of guilt and referred the petitioner to the Department of Corrections for a pre-sentence investigation.
