For convenience the parties will be referred to herein in the order of their appearance in the trial court, which was converse to the order of their appearance on appeal.
J. O. Campbell brought an action in the common pleas court of Tulsa county, alleging in his petition that on November 28, 1924, he became the owner of 7/16 of the mineral rights under the Maxwell farm, subject to an oil and gas lease which provided for the delivery of Vs of the oil as royalty to the pipe line company.
