HECHT, Justice.

Hugo W. Schoellkopf, Jr., his wife, Caroline H. Schoellkopf, and R.L. Pledger were sued as co-guarantors of the debt of a bankrupt corporation in which Hugo Schoellkopf and Pledger were shareholders. The Schoellkopfs eventually paid the entire debt and cross-claimed from Pledger contribution of Ms share. Pledger denied liability to the Schoellkopfs and in turn cross-claimed against them for actual and punitive damages he alleged were caused by their tortious conduct against the corporation.
