This case was submitted to this: court, on the 10th day of March, 1906, at which time appellants were allowed ten days to file an additional brief and the respondent alloAved ten days thereafter to file a reply brief.

The appellants had served respondent with a copy of what they denominated their abstract twenty days before the case was set for trial, Avhich was the 9th day of March, 1906. The respondent had served appellants with a counter abstract, brief and argument on the 22nd day of February, 1906, in which he suggested that there was no record entry whatever of the signing or filing of…
