HANSON, Justice.

We are asked by proceedings in certiorari to review a ruling made by the district court of Salt Lake county in a cause therein pending between Jacob Olson, the plaintiff herein, as plaintiff, and Richard Evans, one of the defendants herein, as defendant.

The record as certified to us shows that plaintiff filed a complaint in said district court against Richard Evans to recover damages for personal injuries alleged to have been sustained by him when struck by Evans’ automobile.
