This is an action based on negligence to recover damages for personal injuries. The plaintiff, Gertrude S. DeWitt, was thrown to the pavement while walking across a street in the city of Portland, and claims that she was run into by an automobile truck owned and operated by the defendant. The defendant denied on information and belief that the plaintiff came in contact with its truck at all, and alleged plaintiff’s contributory negligence, the act of a third party, and unavoidable accident as defenses.
